1. Introduction

These Terms of Service ("Terms") govern your access to and use of the FuelPrice website and API services ("Service") operated by FuelPrice ("we", "us", "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Service.

These Terms are governed by and construed in accordance with the laws of the Republic of South Africa, including the Consumer Protection Act 68 of 2008 ("CPA"), the Electronic Communications and Transactions Act 25 of 2002 ("ECTA"), and the Protection of Personal Information Act 4 of 2013 ("POPIA"), to the extent applicable.

2. Service Description

FuelPrice provides South African fuel price data sourced from legitimate official channels. The Service includes:

A free public website for viewing current and historical fuel prices
A paid API for programmatic access to fuel price data
A Fuel Station Directory allowing fuel station owners to list and manage their stations

3. Service Provided "As Is"

The Service is provided on an "as is" and "as available" basis, without warranties of any kind, whether express, implied, or statutory. To the fullest extent permitted by South African law, we disclaim all warranties, including but not limited to:

Merchantability or fitness for a particular purpose
Accuracy, completeness, or reliability of any data
Uninterrupted or error-free operation
That defects will be corrected
That the Service is free of viruses or harmful components

You acknowledge that errors, omissions, and inaccuracies may occur in the data provided. Fuel price data is sourced from official publications and may not reflect the exact price at any particular fuel station. We are not liable for any decisions made based on data obtained through the Service.

4. API Credits and Payment

The API operates on a credit-based system. Users purchase credits by selecting a plan and paying via EFT (Electronic Funds Transfer). Credits are activated once payment has been confirmed.

Each successful API call deducts one credit from your balance.
Credits do not expire unless your plan has a specified expiry date.
Unused credits are not transferable between accounts.
We reserve the right to change pricing at any time, with notice to existing users.

5. Station Owner Directory

The Station Owner Directory allows fuel station owners to claim their station, choose a subscription tier, and manage their station listing. By using the Station Owner Directory, you agree to the following additional terms:

5.1 Station Claims

You may only claim a station that you own or are authorised to manage.
All claims are subject to manual review and approval by FuelPrice.
We reserve the right to reject or revoke any claim without reason.
Submitting false or misleading information in a claim is a violation of these Terms.

5.2 Station Listing Access

Station listings on FuelPrice are provided free of charge. All approved station owners receive full premium access at no cost, including fuel price management, facilities listing, loyalty programme display, featured map placement, 90-day analytics, and QR code marketing. There are no subscription fees, invoices, or payment requirements for station listings.

5.3 Station Listing Content

You are responsible for the accuracy of all information you publish (prices, contact details, facilities, etc.).
Fuel prices displayed on your listing are self-reported and not verified by FuelPrice.
We reserve the right to remove or edit any content that is false, misleading, or inappropriate.

5.5 QR Code Marketing

Station owners may create up to five (5) trackable QR codes that redirect scanners to a destination URL of the owner's choosing. By using the QR code feature, you agree to the following:

You are solely responsible for the content and legality of the destination URLs you configure.
Destination URLs must not link to malicious, fraudulent, illegal, or inappropriate content.
FuelPrice reserves the right to deactivate any QR code whose destination URL violates these Terms or applicable law, without prior notice.
QR codes are tied to your active station listing. If your claim is revoked, your QR codes will be deactivated.
Scan analytics (scan count, partial IP, user agent) are collected to provide you with usage statistics. See our Privacy Policy for details on how scan data is handled.
FuelPrice does not guarantee any minimum number of scans and is not liable for lost traffic due to QR code downtime or deactivation.

5.6 Station Listing Activation

Station listings are activated by FuelPrice upon approval of your ownership claim. No payment is required. FuelPrice reserves the right to suspend or revoke a listing at any time in accordance with these Terms.

6. No Refunds

All purchases of API credits are final and non-refundable. By purchasing credits, you acknowledge and agree that no refunds will be issued under any circumstances, including but not limited to:

Unused or partially used credits
Service downtime or interruptions
Data inaccuracies or errors
Dissatisfaction with the Service
Account termination due to violation of these Terms

This no-refund policy is disclosed in accordance with ECTA Section 44 and constitutes part of the terms of the transaction agreed to prior to purchase.

7. Service Availability

We strive to maintain the Service at the highest possible uptime, but we do not guarantee 100% availability. The Service may be interrupted due to:

Scheduled or unscheduled maintenance
Server or infrastructure failures
Third-party service outages (including upstream data sources)
Force majeure events (including power outages, natural disasters, internet disruptions)

We shall not be liable for any loss or damage arising from service interruptions or downtime. No credits will be refunded or compensated for periods of unavailability.

8. Acceptable Use

You agree not to:

Use the Service for any unlawful purpose
Attempt to gain unauthorised access to any part of the Service
Exceed rate limits or abuse the API in a manner that degrades service for other users
Reverse-engineer, decompile, or disassemble the Service
Redistribute API data for commercial purposes without our written consent
Share, sell, or transfer your API key to third parties

We reserve the right to suspend or terminate your access without notice if you violate these Terms.

9. Limitation of Liability

To the maximum extent permitted by South African law, FuelPrice, its owners, employees, and affiliates shall not be liable for any:

Direct, indirect, incidental, special, consequential, or punitive damages
Loss of profits, revenue, data, or business opportunities
Damages arising from reliance on data provided by the Service
Damages resulting from service interruptions or data errors

In no event shall our total liability exceed the amount you paid for API credits in the twelve (12) months preceding the claim.

10. Intellectual Property

All content, design, code, and branding associated with FuelPrice are our intellectual property. Fuel price data is sourced from publicly available official publications. You may use API data for your own internal or commercial applications, but you may not resell the raw data feed without our written consent.

11. Indemnification

You agree to indemnify, defend, and hold harmless FuelPrice and its owners from and against any claims, losses, damages, liabilities, and expenses (including legal fees) arising out of your use of the Service or violation of these Terms.

12. Modifications

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated "Last updated" date. Continued use of the Service after changes are posted constitutes acceptance of the modified Terms.

13. Governing Law and Jurisdiction

These Terms are governed by the laws of the Republic of South Africa. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of the Republic of South Africa.
